DCA MMA Waiver
Released Parties include Drilich Combat Academy Pty Ltd trading as DCA MMA, and its directors, owners, officers, employees, coaches, contractors, volunteers, agents, affiliates, insurers, and landlords. Releasing Parties include the participant and, where applicable, their spouse, parents, guardians, heirs, next of kin, and legal representatives.
This waiver applies to all DCA MMA activities, whether on or off the premises, including (without limitation) MMA, Brazilian Jiu-Jitsu, striking/kickboxing, sparring, boxing, wrestling, seminars, Muay Thai, weightlifting, drilling, open mat, strength & conditioning, sauna and ice bath use, and any free trials, casual visits, private sessions, events, training camps, or attendance on the premises as a participant or observer.

Assumption of Risk
I understand that participation in martial arts and combat sports (including MMA, kickboxing, wrestling, boxing, Muay Thai, Yoga, weightlifting, Brazilian Jiu-Jitsu, striking, sparring, strength & conditioning, sauna and ice bath use) involves inherent and unavoidable risks. These risks include physical contact with other participants, falls, throws, takedowns, strikes, submissions, overexertion, dehydration, heat or cold exposure, and equipment-related hazards. I acknowledge that these activities may result in minor or serious injury, and that in rare cases, as with any contact sport, death may be a possibility. I understand that these risks cannot be eliminated and I voluntarily choose to participate with full knowledge and acceptance of these risks.
Medical Fitness
I confirm that I am physically and mentally fit to participate, have no known or reasonably knowable medical, physical, or mental condition that would make participation unsafe, have not been advised by a medical practitioner to avoid such activity, and accept ongoing responsibility to monitor my condition and immediately cease participation and notify staff if I feel unwell, injured, or unsafe.
Waiver of Liability
To the maximum extent permitted by law, I waive, release, and discharge Drilich Combat Academy Pty Ltd (DCA MMA), its directors, staff, coaches, contractors, and volunteers from any claims for injury, illness, death, or property loss arising from my participation, including claims arising from ordinary negligence, but excluding reckless conduct which cannot be excluded by law.
Indemnity
I agree to indemnify and hold harmless DCA MMA against any claims, losses, or legal costs arising from my participation or my conduct.
Emergency Medical Treatment
I authorise DCA MMA, its staff and agents, to provide first aid and, if deemed necessary, to arrange emergency medical treatment, ambulance services, or hospitalisation on my behalf, and to contact my nominated emergency or alternate contact at their discretion. I accept full responsibility for all medical, ambulance, hospital, and transport costs incurred.
Photography & Media
I grant DCA MMA the unrestricted right to photograph, film, or otherwise record my image, voice, or likeness while on the premises or participating in DCA MMA activities. I consent to the use, reproduction, publication, editing, and distribution of such material for marketing, promotional, advertising, and commercial purposes, including use on websites, social media, and other media now or in the future, without compensation. I waive any right to inspect or approve the finished product and acknowledge that all such material remains the sole property of DCA MMA. Where the participant is under 16 years of age, I confirm that I am the parent or legal guardian and I grant this consent on their behalf.
Conduct & Premises Control
I agree to follow all gym rules and staff instructions. Bullying, harassment, antisocial or unsafe behaviour will not be tolerated. DCA MMA reserves the right to refuse entry or escort any person from the premises at its discretion.
Solicitation
While on DCA MMA premises or participating in DCA MMA activities, I will not solicit, coerce, or recruit members to join another gym or engage in conduct intended to disrupt DCA MMA’s business or community.
Personal Property
All personal property brought onto the premises is at my own risk.
Minors
Where the participant is under the age of 16 years, I confirm that I am the participant’s parent or legal guardian and that I have the legal authority to consent on their behalf. I acknowledge and agree that the minor’s participation in DCA MMA activities involves inherent risks, and I consent to and accept those risks on behalf of the minor. I further agree, on behalf of myself and the minor, to be bound by the terms of this Assumption of Risk, Waiver of Liability, and Indemnity, including the release and indemnification of Drilich Combat Academy Pty Ltd trading as DCA MMA, to the maximum extent permitted by law. I authorise DCA MMA to provide first aid, arrange emergency medical treatment, and contact the nominated emergency or alternate contact if required, and I accept responsibility for all medical, ambulance, and transport costs incurred on behalf of the minor.
Governing Law
This agreement is governed by the laws of Western Australia. Please note this waiver can affect your legal rights.
